FOSS patents said that Apple wants Samsung to hand them $40 for each unit of the Samsung Galaxy phones they sell, including the Samsung Galaxy S5.
The legal battle between Samsung and Apple is continuing and it has taken a new twist as Cupertino wants on average $8 for each of the 5 patents of theirs that are being used against Samsung in the second lawsuit which is scheduled to start later on this month.
Samsung are asking Apple for royalties of 2.4% per every iPhone sold for use of patents which have been considered essential for certain wireless standards.
New documents have been unearthed which show that Apple has requested licensing fees for five patents, these are phone number tapping features, unified search, data synchronisation, slide to unlock and auto complete.
Apple wants Samsung to boost the prices of their devices in order to make up the fees, which would mean the consumer would have to pay more.
Analyst Florian Mueller said “the highest per-unit royalty estimate” till date was in the $10 range for Nokia’s entire standard essential patents (SEP) and non-SEPs. Similarly, Microsoft is charging Android device makers $15 to $20 per unit for its whole patent portfolio.”
“Apple’s royalty-type damages claim for five software patents is all so far out of the ballpark of anything that has ever been claimed or rumored to be paid in this industry for entire portfolios.”
Mueller said that the $40 per unit request happens to conflict with the previous actions of Apple. In the first trial between Apple and Samsung, the per device request was just a fraction of what they are asking for now. The per unit Pinch to Zoom was $3.10 and Over Scroll to Bounce along with Tap to Zoom came in at $2.02 each. This meant $7.14 for the three patents.
