We’ve been hearing about AT&T’s unfair data throttling antics of its unlimited data plan users for sometime now however this is the first time that we’ve seen it successfully taken to small claims court.
iPhone user with unlimited data plan awarded $850 after court rules in his favor
According to MercuryNews, Matt Spaccarelli, an unemployed truck driver and student, was awarded $850 after Pro-tem Judge Russell Nadel found that AT&T wasn’t being fair with the unlimited data plan throttling limits.
According to Spaccarelli, his phone was being throttled after he used around 1.5 gigabytes to 2 gigabytes of data within a month. This of course wasn’t fair given that AT&T provides 3GB of data to subscribers on a tiered plan that costs the same ($30).
With close to 17 million AT&T users reportedly on the unlimited data plan, this ruling may have opened the floodgates to more similar cases in small claims court against the second largest carrier in the US.
